Sale of a Parsonage to a Pastor

Question:

To show appreciation to its pastor, a church would like to sell him its parsonage for a nominal value. Will this sale at well below fair market value cause any unintended tax consequences?

Answer:

Yes, this sale will essentially increase the pastor's income by the difference between the bargain sale price and fair market value of the property, reportable on his W-2 as taxable compensation. A "gift" of this sort made with the best intentions may cause an extremely high tax burden to the pastor, including both income and self-employment taxes. The church could provide the pastor with a cash bonus along with the parsonage sale to help him pay some of the taxes. However, the cash bonus will also be taxable compensation.

There are ways to minimize the tax effects of a transaction of this nature, but those require careful thought and consideration of the situation of the church and pastor.

Question: A church rented space from another church last year. Should it request a completed Form W-9 and issue Form 1099-MISC? Answer: Payments from one 501(c)(3) organization to another 501(c)(3) organization are not subject to Form 1099-MISC reporting. Form 944 or 941 Filing for Churches

Question:   A new church filed for an employer identification number (EIN) recently. It received notification from the IRS about the EIN, stating that the church must file Form 944 by the following January deadline. The church has no non-ministerial staff members. Since income tax withholding is elective by ministers and none of the pastors has elected to request non-mandatory withholding is the church required to file Form 944 annually? Also, a quarterly Form 941 (rather than an annual Form 944) is required of some employers. Which IRS form, if any, should be filed?
